For the first part of the argument, you can't transmute over a long distance without changing everything in the way first, and can't chance the basic attributes of what you're transmuting. For example, you could change all the air in a room to poison gas, but not just change the air in someone's lungs. You also couldn't change the air in the room to a liquid, unless you froze it first into liquid form. Thus, poison gas in the room would a fortitude save.
